Amir Hussein, a 30-year-old Pakistani resident of Fgura, was placed under custody following allegations that he had sexually assaulted a defenseless 17-year-old female.
He is employed as a Bolt driver, according to Magistrate Ann Marie Thake. According to the police report, Amir wanted to have sex with the victim.
The prosecution clarified that the incident occurred on 4th June. The 17-year-old victim, whose identity cannot be disclosed due to her age, boarded the accused’s cab as reported by TVM News.
She claimed she had no money, even though the trip was worth €4. They exchanged phone numbers, and around 11.30pm, he texted her to say he would come get her and take her to the Blue Grotto.
The accused took her hand and put it on his privates, according to what the court heard. She declined his request for them to engage in sexual activity. The victim was occasionally at Mount Carmel Hospital, according to the police.
The accused pleaded not guilty, and his defense asked for bail. But because the accused was aware of the victim’s residence, the prosecution objected. There will be a Protection Order, according to the Defense.
It argued that the court has not yet heard what she attempted to do to the accused. In order to notify the police if he got close to the girl’s house, electronic tagging was considered.
The Defence also said he had a clean Conduct Record and he did not know the girl was vulnerable and she accepted to go with him to the Blue Grotto at midnight.
The Magistrate said the girl has yet to testify and she is vulnerable. The accused knew where she lived and had her mobile number and electronic tagging is not a guarantee and the accused was detained under arrest.
The accused was defended by lawyers Nicholas Mifsud and Nicole Falzon. The Prosecution was administered by Police Inspector Antonello Magri and lawyer Kristina Bartolo from the Office of the Advocate General. Lawyer Nicolai Bugeja was parte civile.
