Justice Minister Clifton Grima has pushed back against claims that confidential conversations between lawyers and their clients were secretly recorded inside Corradino Correctional Facility, insisting there is no evidence that any privileged discussions were intercepted.
Speaking to journalists outside Parliament, Grima said the debate should focus on one key question: whether recordings of lawyer-client conversations actually took place, as reported by NetNews.
“The argument needs to be about the facts. Did this happen, or not?” he said.
His comments come amid an ongoing dispute between the government and the Chamber of Advocates, which recently staged a one-day strike over allegations that surveillance equipment had been installed in prison consultation rooms used by high-risk inmates.
The Chamber has cited sworn testimony from two individuals claiming that monitoring equipment was present in multiple meeting rooms at the prison.
While officials have maintained that recordings were switched off whenever lawyers entered, the Chamber argues that the very presence of such equipment raises serious concerns about legal professional privilege.
Grima, however, reiterated the government’s position that confidential conversations between lawyers and clients were never recorded.
“The state stands firmly behind the principle that conversations between lawyers and their clients are privileged,” he said.
When asked whether security officials could still have overheard conversations before recordings were allegedly switched off, Grima said the Malta Security Service has no records indicating that this happened.
The controversy has sparked a wider debate about privacy, due process and the protection of fundamental rights within Malta’s justice system.
While the Chamber of Advocates is continuing to call for an independent inquiry, the government maintains that no privileged lawyer-client conversations were intercepted.
