Jakarta (ANTARA) - Finance Minister Purbaya Yudhi Sadewa clarified that the special protection granted to investors in Patriot Bonds and Red and White Bonds applies only to funds invested in those instruments, not to the owners’ assets or businesses.
"The correct understanding is that the funds used to purchase Patriot Bonds will not be subject to scrutiny regarding their origin. However, if the owner has other businesses, those can still be pursued,” Sadewa told reporters here on Tuesday.
The statement was in response to the inserted Article 50A of Law Number 4 of 2026 on the Development and Strengthening of the Financial Sector (UU P2SK), which regulates legal protection for buyers of special debt securities issued by Danantara.
The protection covers general criminal charges, special criminal offenses including tax-related crimes, as well as civil lawsuits.
Sadewa emphasized that funds entering these bonds will be considered safe. However, the company or business activities of the fund owners will not receive immunity if tax issues or other violations are found.
According to him, this scheme differs from the tax amnesty program. In the tax amnesty, taxpayers receive broader treatment for the assets they declare.
In contrast, under the Patriot Bond scheme, protection applies only to the funds placed in the instrument.
“The company is not immune. So, it’s not like the tax amnesty where everything is free,” he said.
Sadewa also responded to concerns that the policy could accommodate money laundering practices.
According to him, the government aims to encourage funds currently outside the formal financial system to enter the domestic economy.
By bringing in such funds, the government can utilize them for development financing.
“Rather than the money staying outside, it’s better for it to enter the system. There may be a small loss, but in my view, the money enters our economy. We can use it for development,” he said.
