
MANILA, Philippines — The House prosecution panel on Wednesday asked the Senate impeachment court to issue a subpoena for the Bureau of Internal Revenue (BIR) sealed box containing Vice President Sara Duterte’s tax records.
This is after the impeachment court on Monday ordered the return of the box in question to the BIR as there had been no formal directive to turn it over to the court.

But according to presiding officer and Senator-Judge Francis Escudero on Wednesday’s trial proceedings, the counsel for the prosecutors has now filed a motion for the issuance of a subpoena duces tecum and ad testificandum for the BIR box.

Ad testificandum refers to a subpoena that compels a witness to appear in court to testify orally, while a subpoena duces tecum compels a witness to produce specific documents, records, or physical evidence.
Escudero said that the prosecution’s subpoena request will be treated the same as the prosecution panel’s previous similar request, but for the financial records of Duterte and her husband Manases “Mans” Carpio.
“We will accord the same treatment to this with respect to the subpoena for the bank accounts of the spouses, Vice President Sara Duterte and Atty. Mans Carpio, therefore the presiding officer orders both parties to submit memoranda on the subject matter of the subpoena of the BIR records,” said Escudero.
“And we will also schedule the oral arguments for deciding on this issue together with the bank records on Wednesday,” he added. /gsg
